Welcome to SynkCast. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SynkCast ("Company," "we," "us," or "our") governing your access to and use of the SynkCast desktop application, mobile companion applications, website, and all related services (collectively, the "Services").
By downloading, installing, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting on our website or within the application. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Description of Service
SynkCast is a desktop application that provides ultra low-latency screen casting and mirroring capabilities, allowing users to stream content from their mobile devices (Android and iOS) to their personal computers (Windows, macOS, and Linux). The Services include but are not limited to:
- Real-time screen mirroring and casting from mobile devices to desktop computers
- High-quality video streaming with support for up to 4K resolution
- Low-latency transmission optimized for gaming and content creation
- Device pairing and connection management
- Recording and streaming features
- User account management and subscription services
- Customer support and technical assistance
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Services without liability.
The Services are provided on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure at all times.
3. User Accounts
To access certain features of our Services, you must create a user account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account or any other security breach
- Not share your account credentials with any third party
- Not create multiple accounts for fraudulent purposes
We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if your account has been compromised.
You may delete your account at any time through your account settings or by contacting our support team. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.
4. Subscription and Billing
SynkCast offers various subscription plans, including free trial periods and paid subscription tiers. By subscribing to a paid plan, you agree to the following terms:
4.1 Free Trial
New users may be eligible for a free trial period. The duration and features available during the trial period are determined at our sole discretion. At the end of the trial period, you must subscribe to a paid plan to continue accessing premium features. We reserve the right to modify, limit, or discontinue free trial offers at any time.
4.2 Subscription Plans
Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge your designated payment method for the subscription fee at the beginning of each billing cycle.
4.3 Payment Processing
All payments are processed through our third-party payment processor, Razorpay. By making a payment, you agree to Razorpay's terms of service and privacy policy. We do not store your complete payment card information on our servers.
4.4 Price Changes
We reserve the right to change subscription prices at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle. Your continued use of the Services after a price change constitutes your acceptance of the new pricing.
4.5 Failed Payments
If a payment fails, we may attempt to charge your payment method again. If payment continues to fail, your subscription may be suspended or downgraded until payment is successfully processed.
5. Cancellation and Refund Policy
Please read this section carefully as it outlines our cancellation and refund policies.
5.1 No Refunds Policy
All subscription payments are final and non-refundable. Once a payment has been processed for a subscription period, we do not provide refunds, whether partial or full, for any reason including but not limited to:
- Unused subscription time
- Dissatisfaction with the Services
- Failure to use the Services during the subscription period
- Technical issues on your end (device compatibility, network issues, etc.)
- Accidental purchases or renewals
- Change of mind after purchase
We encourage all users to take advantage of any free trial periods offered to evaluate the Services before committing to a paid subscription.
5.2 Cancellation Policy
You may cancel your subscription at any time. Upon cancellation:
- Your subscription will remain active until the end of your current billing cycle.
- You will continue to have access to all premium features until the end of your paid period.
- No further charges will be made to your payment method after cancellation.
- Your account will be downgraded to the free tier (if available) or deactivated at the end of the billing cycle.
- No prorated refunds will be issued for the remaining days in your billing cycle.
5.3 How to Cancel Your Subscription
You can cancel your subscription using any of the following methods:
Option 1: Through the Desktop App
- Open the SynkCast desktop application
- Click on your profile icon in the top-right corner
- Select "Account Settings" or "Manage Subscription"
- Click "Cancel Subscription"
- Confirm your cancellation when prompted
Option 2: Through the Web Dashboard
- Log in to your account at synkcast.com/dashboard
- Navigate to "Subscription" or "Billing"
- Click "Cancel Subscription"
- Follow the prompts to confirm cancellation
Option 3: Contact Support
Email us at support@synkcast.com with the subject line "Cancel Subscription" and include your registered email address. We will process your cancellation within 24-48 hours and send you a confirmation email.
Important: Make sure to cancel at least 24 hours before your next billing date to avoid being charged for the next billing cycle.
5.4 Automatic Renewal
All subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. Here's what you need to know:
- Monthly subscriptions: Renew on the same date each month (e.g., if you subscribed on the 15th, you'll be charged on the 15th of each month)
- Yearly subscriptions: Renew on the anniversary of your original subscription date
- Renewal reminders: We will send you an email reminder 7 days before your subscription renews
- Price changes: If subscription prices change, you will be notified before your renewal date
It is your responsibility to cancel your subscription before the renewal date if you do not wish to be charged for another billing cycle. We recommend setting a reminder if you're unsure about continuing.
5.5 Exceptional Circumstances
In rare exceptional circumstances, we may, at our sole discretion, offer credits or refunds. These circumstances include:
- Extended service outages lasting more than 72 consecutive hours caused solely by us
- Duplicate charges due to technical errors on our end
- Billing errors where you were charged an incorrect amount
To request a review under exceptional circumstances, please contact us at support@synkcast.com with details of your situation. Any decision is made on a case-by-case basis and does not create any precedent or obligation for future situations.
6. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services for any illegal, unauthorized, or fraudulent purpose
- Violate any applicable laws, regulations, or third-party rights
- Transmit or stream any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Infringe upon any intellectual property rights, including copyrights, trademarks, or patents
- Attempt to gain unauthorized access to our systems, networks, or other users' accounts
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the application
- Modify, adapt, or create derivative works based on the Services
- Remove, alter, or obscure any proprietary notices or labels on the Services
- Use the Services to transmit malware, viruses, or any malicious code
- Interfere with or disrupt the integrity or performance of the Services
- Use automated systems, bots, or scripts to access the Services
- Resell, sublicense, or redistribute the Services without our express written consent
- Use the Services to stream copyrighted content without proper authorization
- Circumvent any technical measures we use to provide the Services
We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.
7. Intellectual Property Rights
The Services, including all content, features, functionality, software, designs, text, graphics, logos, icons, images, audio, video, and other materials (collectively, "Content"), are owned by SynkCast or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on devices you own or control, solely for your personal, non-commercial use.
This license does not include the right to:
- Modify or copy the materials except as expressly permitted
- Use the materials for any commercial purpose
- Transfer the materials to another person or mirror the materials on any other server
- Attempt to decompile or reverse engineer any software contained in the Services
All trademarks, service marks, trade names, and logos displayed on the Services are our property or the property of their respective owners. You may not use any of these marks without prior written permission.
8. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will meet your specific requirements or expectations
- The Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- The quality of the Services will meet your expectations
- Any errors in the Services will be corrected
You acknowledge that streaming quality, latency, and performance may vary based on factors outside our control, including but not limited to your internet connection, network conditions, device capabilities, and third-party services.
Any material downloaded or otherwise obtained through the use of the Services is done at your own discretion and risk. You are solely responsible for any damage to your computer system or mobile device or loss of data that results from downloading any such material.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYNKCAST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill
- Cost of procurement of substitute services
- Business interruption
- Personal injury or property damage
- Any other intangible losses
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
10. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of subscription fees
- Extended periods of inactivity
- Requests by law enforcement or government agencies
- Discontinuation or material modification of the Services
Upon termination:
- Your right to use the Services will immediately cease
- You must uninstall and destroy all copies of the application in your possession
- All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
If your account is terminated for violation of these Terms, you are not entitled to any refund of subscription fees.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with applicable arbitration rules.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to a jury trial and agree that you will not seek to participate in any class action lawsuit against us.
Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
